I Just Got Rear-Ended, What Do I Do?
You’re driving to work on an early morning
Or maybe you are driving to a nice restaurant
It could be that you are on your way to the beach
What I’m trying to say is that it could happen at anytime. You can get rear-ended by another car anytime and anywhere, as long as you are in a car. So what do you do when you get rear-ended?
The 4 Steps to Figuring Out The Mess
So now it’s suddenly a messy situation and your entire rear bumper is on the street. What do you do? The first thing is to assess the injuries. Are you injured? Does anywhere hurt? If anywhere hurts, you have to remember that and make sure you tell your personal injury lawyer when the time comes.
Why? Well your insurance provider might not be able to give you the best tips when it comes to personal injury, so it is up to your personal injury lawyer to actually determine where you should go for treatment and how much you are owed. Personal injury lawyers do this for a living, and going to them is probably going to give you the best results.
If you feel like you may be one of these people that needs help, give us a call. FLL Accident Lawyers will definitely be there for you, and the best part is that everything is free unless YOU are going to get compensated for your injuries. We don’t simply just take money when you are suffering too.
Take Pictures of the Car Accident
Now that you know the injuries, take physical evidence of what happened. DO NOT move the cars yet. Take a picture of the position of the cars and the severity of the accident. You want as much evidence to stack up in your favor so that you can get as much out of it as possible. If you are a victim, then you definitely don’t want to be paying for someone else’s irresponsible behavior.
Lots of people actually DON’T take pictures of the accident scene and the damages to their vehicles. That is not a good idea. You can lose lots of money.
In the worst case, the case could completely flip and put you at fault, even though unlikely, it is possible if there is a conflict in stories.
For more information, check out Becker Law and there post on why taking pictures is so critical in compiling physical evidence of the accident scene.
Get Information From the Other Party
Don’t just leave yet, you need to get the information of the other party. When you are in a legal battle with the other party, you will need to communicate with them and get as much information from them as possible.
Honestly, the only things that you will need for 100% sure is their:
- Name
- Insurance Provider
- Phone Number and other contact
Call the Police
Now, you must call the police and get a police report so that they can give that to either party. It is VERY unlikely that you will be getting ticket since you got rear-ended. If you got rear-ended, it is not your fault and you did not break any traffic laws, thus you will probably not be the recipient of the ticket.
Now, you have to tell the officer everything that happened, as accurately as possible. Do not make anything up because if there is a conflict in the story with you and the other party that doesn’t make physical sense, the case could go on for longer and for no reason. If you are not sure about certain details, then say that you are not sure.
If you are unsure of the importance of a police report and what it can do for you, check out this article from Chris Hudson Law. They are a reputable law source and they provide good information.
Report the Accident to Insurance Provider
Now, you must report the accident to your insurance provider. They are the ones covering your car repair bills, so you must report this and also with their adjuster so that they can determine fault. Once fault is determined, you will also be able to discuss with the other adjuster about getting your car fixed.
